CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-123 <br /> <br />APPROVAL OF PROPOSED AGREEMENT WITH WILLOW WEST <br />PROPERTIES, RE: SEWAGE CAPACITY <br /> <br />WHEREAS, <br /> <br />the Livermore-Amador Valley Water Management Agency <br />Joint Powers Agreement includes a provision for ex- <br />pansion of 1 mgd of sewer capacity in the export <br />pipeline for commercial (non-retail) and industrial <br />development of which the City of Pleasanton was given <br />a guaranteed option of .5 mgd; and <br /> <br />WHEREAS, <br /> <br />on March 13, 1979, Willow West properties submitted a <br />proposal to the City Council requesting City to make <br />available to Willow West a portion of the .5 mgd com- <br />mercial (non-retail) and industrial capacity; and <br /> <br />WHEREAS, <br /> <br />Council directed staff to negotiate an appropriate <br />agreement with Willow West Properties and return the <br />agreement to the City Council for final review and <br />action; and <br /> <br />WHEREAS, <br /> <br />at its meeting of July 24, 1979, the City Council re- <br />ceived a report from the City Manager dated July 18, <br />1979, including a proposed agreement with Willow West <br />Properties for the purpose of making the .5 mgd non- <br />retail commercial and industrial capacity available <br />by constructing the necessary facilities with private <br />resources; and <br /> <br />WHEREAS, <br /> <br />representatives of Willow West, adjacent property <br />owners, and staff members were given an opportunity <br />to comment on the proposed agreement; and <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves the agreement between the City and Willow <br /> West Properties concerning making the .5 mgd non-retail <br /> commercial and industrial capacity available by construct- <br /> ing the necessary facilities with private resources as <br /> submitted in Staff Report SR79:161, dated July 18, 1979, <br /> with the added conditions that a consultant approved by <br /> the City be engaged within (90) days and that preliminary <br /> design and environmental studies be completed within one <br /> (1) year. <br /> <br />Section 2. The appropriate City officals are hereby authorized to <br /> execute the agreement described in Section 1 above. <br /> <br />Section 3. This resolution shall be effective immediately. <br /> <br />III <br /> <br /> <br />
