CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 79-122 <br />DELEGATING TO CITY MANAGER RESPONSIBILITY FOR <br />PROCESSING OF DISABILITY RETIREMENT OF <br />PUBLIC SAFETY EMPLOYEES <br /> <br />WHEREAS , <br /> <br />the State of California Public Employee's Retirement <br />Law provides for the disability retirement of employees <br />covered under said law; and <br /> <br />WHEREAS, the City of Pleasanton and its employees are members <br /> of the Public Employees Retirement System (PERS); and <br /> <br />WHEREAS, <br /> <br />in the event a public safety member applies for <br />disability retirement the employer must determine if <br />the employee is disabled and if the disability is <br />industrial or not; and <br /> <br />WHEREAS, the appropriate City official to make said determi- <br /> nations required of the City is the City Manager. <br /> <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br />Section <br /> <br />1. The City Council of the City of Pleasanton hereby <br />delegates to the City Manager the responsibility for <br />making all determinations regarding disability as <br />required by PERS and executing all documentation per- <br />taining thereto. <br /> <br />Section 2. This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />ADOPTED at a regular meeting of the City Council of the City of <br />Pleasanton on July 24, 1979, by the following vote: <br /> <br />AYES: Councilmembers .........
