CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-173 <br /> <br />APPROVING A NEGATIVE DECLARATION ON THE APPLICATION OF <br />MICHELLE MYERS TO REZONE AN 9.1 ACRE SITE LOCATED EAST <br />OF SANTA RITA ROAD APPROXIMATELY 120 FEET NORTH OF MOHR <br />AVENUE FROM THE P (PUBLIC AND INSTITUTIONAL) DISTRICT <br />TO THE PUD (PLJ~NNED UNIT DEVELOPMENT) AID 0 (OFFICE) DISTRICTS <br /> <br />WHEREAS, <br /> <br />the City Council, at its meeting of September 18, 1979 <br />received a proposed negative declaration for application <br />of Michelle Myers (PUD-79-5) to rezone an 8.1 acre site <br />from P (Public and Institutional) District to PUD <br />(Planned Unit Development) District and a 1 acre parcel <br />to 0 (Office) District located east of Santa Rita Road <br />approximately 120 feet north of Mohr Avenue (hereinafter <br />referred to as the Project); and <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />staff has determined that the proposed rezoning is a <br />project for the purposes of the California Environmental <br />Quality Act; and <br /> <br />an Initial Study done pursuant to the Environmental Impact <br />Guidelines and Procedures adopted by the City Council of the <br />City of Pleasanton by Resolution No. 77-66 was prepared for <br />the Project; and <br /> <br />the City Council, at its meeting of September 18, 1979 also <br />received that Initial Study dated .April 23, 1979; and <br /> <br />WHEREAS, <br /> <br />each member of the City Council had a copy of Resolution No. <br />77-66 at the time of considering the proposed Negative <br />Declaration and Initial Study; and <br /> <br />WHEREAS, <br /> <br />the public was afforded an opportunity to comment on the <br />proposed environmental assessment, which had been published <br />in the Pleasanton Times, a newspaper of general circulation; <br /> <br />and <br /> <br />WHEREAS, <br /> <br />the City Council is aware of the provisions of the City's <br />Guidelines and Processing Procedures for the evaluation of <br />projects and the preparation of Environmental Impact Report <br />as they pertain to requirements for Negative Declarations <br />and Environmental Impact Reports. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. The City Council determines that the proposed rezoning <br /> application (PUD-79-5) would not have any significant adverse <br /> effects on the environment and therefore no Environmental <br /> Impact Report shall be prepared. <br /> <br />III <br /> <br /> <br />
