CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-170 <br /> <br />ACCEPTANCE OF GRANT DEED DATED JUNE 20, 1979, FROM <br />TAM INVESTMENT COMPANY, INC. FOR 3 PARCELS OF PROP- <br />ERTY FOR RIGHT-OF-WAY PURPOSES AND PUBLIC SERVICE <br />EASEMENTS <br /> <br />~IEREAS,. City is in receipt of an offer of dedication from Tam <br /> InveStment Company, Inc., of three parcels of property <br /> as follows: <br /> <br /> 1. Dedication of a 0.49 acre parcel of land along <br /> Hopyard Road frontage for street right-of-way <br /> purposes. <br /> <br /> 2. Dedication of a 0.015 acre parcel of land to <br /> provide for City fee ownership of the existing <br /> City Well No. 7. <br /> <br /> 3. Grant of public service easement to provide for <br /> vehicular access and for maintenance of existing <br /> and proposed utilities. <br /> <br />WHEREAS, the City Council, at their meeting of September 18, 1979 <br /> received a report from the Director of Public Works and <br /> Utilities dated September 14, 1979, indicating that the <br /> acceptance of this dedication is in the public interest; and <br /> <br />WHEREAS, the report of the Director of Public Works and Utilities <br /> indicated that it would be in order for the City to execute <br /> a quitclaim deed to Tam Invesment quitclaiming "surface <br /> entry right" outside the dedicated well site area (water <br /> well drilling rights), and the interest in the portion of <br /> old Valley Avenue between Hopyard Road and the City well site. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. The offer of dedication from Tam Investment Co., Inc., <br /> manifested in the Grant Deed dated June 20, 1979, is <br /> hereby accepted and the appropriate City officers instruc- <br /> ted to take whatever action necessary to implement said <br /> acceptance. <br /> <br />Section 2. The Mayor is authorized to execute a quitclaim deed to <br /> Tam Investment Co., Inc., quitclaiming "surface entry rights" <br /> outside the dedicated well site area (water well drilling <br /> rights), and quitclaiming an interest in the portion of old <br /> Valley Avenue between Hopyard Road and the City well site. <br /> <br />III <br /> <br /> <br />
