CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-167 <br /> <br />APPROVING AND AUTHORIZING THE EXECUTION OF AN AMENDMENT <br />TO THE CITY'S CONTRACT WITH ALAMEDA COUNTY ZONE 7 RELAT- <br />ING TO WATER PURCHASE AND RESALE <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton has purchased water for resale from <br />Alameda County Zone 7 since 1968, as provided under a con- <br />tract between the City and Alameda County Zone 7; and <br /> <br />WHEREAS, the current five-year formula period established by the con- <br /> tract expires this year; and <br /> <br />WHEREAS, <br /> <br />the City Council, at its meeting of September 11, 1979, <br />received a report from the City Manager dated August 27, <br />1979, recommending approval of a contract amendment pro- <br />posed by Zone 7 which would eliminate the five-year <br />formula based rate setting mechanism and which would <br />substitue an annual rate setting provision. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section <br /> <br />1. Approves the amendment to the City's contract with <br />Alameda County Zone 7 relating to water purchase and <br />resale which would eliminate the five-year formula <br />based rate setting mechanism and substitute an annual <br />rate setting provision. <br /> <br />Section 2~ Authorizes execution of the amendment to the contract <br /> by the appropriate City officials. <br /> <br />Section 3.
