CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-163 <br /> <br />A RESOLUTION MODIFYING PLANNING COMMISSION APPROVAL OF <br />A CONDITIONAL USE PERMIT AT 3701-23 OLD SANTA RITA ROAD <br />(UP-79-15) TO PROHIBIT PICKUPS OR DELIVERIES BY TRACTOR <br />TRAILERS BETWEEN TWELVE MIDNIGHT AND 6:00 A.M. <br /> <br />WHEREAS, <br /> <br />the Planning Cormmission, on July 26, 1979, enacted UP-79-15 <br />setting forth permits for a conditional use permit for <br />limited warehousing purposes at 3701-23 Old Santa Rita <br />Road; and <br /> <br />WHEREAS, said conditional use permit was appealed to the City Council <br /> by Robert Pearson, et al; and <br /> <br />WHEREAS, the City Council held a public hearing of August 28, 1979, <br /> regarding said appeal; and <br /> <br />WHEREAS, the matter was continued to September 11, 1979, for further <br /> Council action; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. That the approval of UP-79-15 be modified to add the <br /> following condition: <br /> <br />"No pickups or deliveries shall be made by <br />tractor trailer vehicles between the hours <br />of 12:00 midnight and 6:00 a.m." <br /> <br />Section 2. The basis for this amendment to Conditional Use Permit <br /> UP-79-15 is to prevent the disturbance of the residents whose <br /> houses back on Santa Rita Road by early morning pick ups and <br /> deliveries. <br /> <br />Section 3.
