CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAmeDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-164 <br /> <br />DENYING APPEAL OF ROBERT PEARSON, ET AL, OF A DECISION <br />OF THE CITY PLANNING COMMISSION GRANTING A CONDITIONAL <br />USE PERMIT FOR LIMITED WAREHOUSING PURPOSES AS 3701-23 <br />OLD SANTA RITA ROAD (UP-79-15) <br /> <br />WHEREAS, <br /> <br />the Planning Commission on July 26, 1979, approved a condi- <br />tional use permit UP-79-15, setting forth permits to allow <br />the warehousing and wholesaling of certain products in the <br />commercial service complex located at 3701-23 Old Santa <br />Rita Road; and <br /> <br />WHEREAS, said conditional use permit was appealed to the City Council <br /> By Robert Pearson, et al; and <br /> <br />WHEREAS, <br /> <br />the City Council held a public hearing on August 28° 1979, <br />regarding said appeal, at which time ~he public hearing was <br />continued to September 110 1979, for further Council action; <br />and <br /> <br />WHEREAS, <br /> <br />on September 11, 1979, Council took action adopting Resolution <br />79-163, modifying the conditional use permit to prevent deliv- <br />eries and pick ups between the hours of 12:00 midnight and <br />6:00 a.m. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Denies the appeal of Robert Pearson, et al, of a decision <br /> of the Planning Commission granting a conditional use permit <br /> for limited warehousing purposes at 3701-23 Old Santa Rita <br /> Road (UP-79-15). <br /> <br />Section 2. This resolution shall be effective immediately. <br /> <br />THIS RESOLUTION ADOPTED ON SEPTEMBER 11, 1979, BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers- Butler, Kephart and Mercer <br /> <br />NOES: Councilmember Wood and Mayor Brandes <br />ABSENT: None <br /> <br />ATTEST: ~ <br /> <br />jTla~y~n E.
