CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-161 <br /> <br />APPROVING A NEGATIVE DECLARATION FOR CASE PUD-79-6, THE <br />APPLICATION OF HENRY CUPPLES TO REZONE A 6.1 ACRE SITE <br />LOCATED AT THE SOUTHWEST CORNER OF HOPYARD ROAD AND 1-580 <br />FROM THE C-F (FREEWAY COMmeRCIAL) DISTRICT TO THE PUD <br />(PLANNED UNIT DEVELOPMENT) DISTRICT <br /> <br />WHEREAS, <br /> <br />the City Council, at its meeting of September 11, 1979 <br />received a proposed negative declaration for the application <br />to rezone a 6.1 acre site located at the southwest corner of <br />Hopyard Road and 1-580 from the C-F (Freeway Commercial) <br />District tothe PUD (Planned Unit Development) District <br />(hereinafter referred to as the Project); and <br /> <br />WHEREAS, <br /> <br />staff has determined that the proposed rezoning as described <br />above is a project for the purposes of the California <br />Environmental Quality Act; and <br /> <br />WHEREAS, <br /> <br />an Initial Study done pursuant to the Environmental Impact <br />Guidelines and Procedures adopted by the City Council of <br />the City of Pleasanton be Resolution No. 77-66 was prepared <br />for the Project; and <br /> <br />WHEREAS, the City Council, at its meeting of September 11, 1979 also <br /> received that Initial Study dated June 29, 1979; and <br /> <br />WHEREAS, <br /> <br />each member of the City Council had a copy of Resolution No. <br />77-66 at the time of considering the proposed Negative <br />Declaration and Initial Study; and <br /> <br />WHEREAS, <br /> <br />the public was afforded an opportunity to comment on the <br />proposed environmental assessment, which had been published <br />in the Pleasanton Times, a newspaper of general circulation; <br /> <br />and <br /> <br />WHEREAS, <br /> <br />the City Council is aware of the provisions of the City's <br />Guidelines and Processing Procedures for the evaluation of <br />projects and the preparation of Environmental Impact Report <br />as they pertain to requirements for Negative Declarations <br />and Environmental ImpaCt Reports. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section <br /> <br />1. The City Council determines that the proposed rezoning of <br />a 6.1 acre site located at the southwest corner of Hopyard <br />Road and 1-580 from the C-F (Freeway Commercial) District to <br />the PUD (Planned Unit Development) District would not have <br />any significant adverse effects on the environment and there- <br />fore no Environmental Impact Report shall be prepared. <br /> <br />III <br /> <br /> <br />
