CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-220 <br /> <br />A RESOLUTION APPROVING A MITIGATED NEGATIVE DECLARATION <br />FOR THE APPLICATION OF FLYING "J", INC., TO REZONE A 60 <br />ACRE SITE LOCATED IMMEDIATELY SOUTH OF JOHNSON DRIVE <br />AND ABOUT 700 FEET WEST OF HOPYARD ROAD TO PUD (PLANNED <br />UNIT DEVELOPMENT-INDUSTRIAL AND COMMERCIAL) DISTRICT <br /> <br />WHEREAS, <br /> <br />the City Council, at its meeting of November 13, 1979, <br />received a proposed mitigated negative declaration for <br />the application of Flying "J", Inc., to rezone a 60 acre <br />site located immediately south of Johnson Drive and about <br />700 feet west of Hopyard Road to PUD (Planned Unit Develop- <br />ment-Industrial and Commercial) District (hereinafter re- <br />ferred to as the Project); and <br /> <br />WHEREAS, <br /> <br />staff has determined that the proposed application for <br />rezoning approval of a Planned Unit Development is a <br />project for the purposes of the California Environmental <br />Quality Act; and <br /> <br />WHEREAS, <br /> <br />an Initial Study done pursuant to the Environmental Impact <br />Guidelines and Procedures adopted by the City Council of <br />the City of Pleasanton by Resolution No.77-66 was prepared <br />for the Project; and <br /> <br />WHEREAS, the City Council, at its meeting of November 13, 1979, also <br /> received that Initial Study dated October 10, 1979; and <br /> <br />WHEREAS, <br /> <br />each member of the City Council had a copy of Resolution No. <br />77-66 at the time of considering the proposed Mitigated Neg- <br />ative Declaration and Initial Study; and <br /> <br />WHEREAS, <br /> <br />the public was afforded an opportunity to comment on the <br />proposed environmental assessment, which had been published <br />in the Pleasanton Times, a newspaper of general circulation; <br /> <br />and <br /> <br />WHEREAS, <br /> <br />the City Council is aware of the provisions of the City's <br />Guidelines and Processing Procedures for the evaluation of <br />projects and the preparation of Environmental Impact Report <br />as they pertain to requirements for Mitigated Negative Dec- <br />larations and Environmental Impact Reports. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. <br /> <br />III <br /> <br /> Approves a mitigated negative declaration for the application <br />of Flying "J" Oil Company to rezone approximately 60 acres of <br />land located south of Johnson Drive and about 700 feet west of <br />Hopyard Road to the PUD (Planned Unit Development-Industrial <br />and Cor~nercial) District (Zoning Unit Map #201) and <br />the development plan for a motel proposed to be located on <br /> <br /> <br />
