CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-204 <br /> <br />A RESOLUTION DENYING WITHOUT PREJUDICE THE APPEAL OF <br />AMADOR VALLEY INVESTORS FROM A DECISION OF THE PLAN- <br />NING COmmISSION DENYING THE APPLICATION FOR REZONING <br />AN APPROXimaTELY 27.2+ ACRES PARCEL LOCATED JUST EAST <br />OF THE EXISTING TElMINUS OF WEST LAS POSITAS BOULEVARD <br />DESCRIBED AS ASSESSOR'S PARCEL NO. 99B-3961-27-2 FROM <br />A (AGRICULTURAL) DISTRICT TO THE PUD (PLANNED UNIT <br />DEVELOPMENT) DISTRICT <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />Amador Valley Investors made application to rezone a 27.20+ <br />acre site located just east of th~ existing terminus of We~t <br />Las Positas Boulevard described as Assessor's Parcel No. 99B- <br />3961-27-2 from A (Agricultural) District to the PUD (Planned <br />Unit Development) Di'strict; and <br /> <br />the Planning Commiss'i0n, at its meeting of October 19, 1979, <br />received a staff report on the application, an Initial Study <br />prepared for the project, and testimony from the applicant <br />and community; and <br /> <br />WHEREAS, the Planning Commission denied the applicant's rezoning <br /> request and development plan; and <br /> <br />WHEREAS, the applicant requested a hearing before the City Council <br /> on his denied application; and <br /> <br />WHEREAS, <br /> <br />the City Council, at its October 23, 1979, meeting received <br />a staff report, an Initial Study and at a public hearing took <br />testimony from the applicant, staff and the public; and <br /> <br />WHEREAS, the Planning Commission had determined that the project would not <br /> have a significant impact on the environment. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOW: <br /> <br />Section 1. Denies without prejudice, the appeal of Amador Valley <br /> Investors from a decision of the Planning Commission denying <br /> an application to rezone an approximately 27.20+ acre parcel <br /> located just east of the existing terminus of W~st Las Positas <br /> Boulevard described as Assessor's Parcel No. 99B-3961-27-2 <br /> from A (Agricultural) District to the PUD (Planned Unit Devel- <br /> opment) District. <br /> <br />Section 2. This resolution shall be effective immediately. <br /> <br />III <br /> <br /> <br />
