CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-203 <br /> <br />A RESOLUTION DENYING WITHOUT PREJUDICE THE APPEAL OF <br />GEORGE OAKES, AMADOR VALLEY INVESTORS, FROM A DECISION <br />OF THE PLANNING COMMISSION DENYING AN APPLICATION TO <br />REZONE.AN 8.8 AC~.SITE LOCATED EAST OF THE EXISTING <br />DEVELOPmeNT ON CHUF~HILL DRIVE AND SOUTH OF THE EX- <br />TENSION OF FAIRLANDS DRIVE FROM THE R-1-6500(SINGLE- <br />FAMILY RESIDENTIAL) DISTRICT TO THE PUD (PLANNED UNIT <br />DEVELOPMENT) DISTRICT <br /> <br />WHEREAS , <br /> <br />George Oakes, Amador Valley Investors, made application to <br />rezone an 8.8 acre site located east of the existing dev- <br />elopment on Churchill Drive and south of the extension of <br />Fairlands Drive from the R-1-6500 (Single-Family Residential) <br />District to the PUD (Planned Unit Development) District and <br />to receive approval of a development plan for a 41-lot single- <br />family detached residential aubdivision; and <br /> <br />WHEREAS, <br /> <br />the Planning Commission, at its meeting of October 10, 1979 <br />received a staff report on the application, an Initial Study <br />prepared for the project and testimony from the applicant and <br />community; and <br /> <br />WHEREAS, <br /> <br />the Planning Commission entered and adopted Resolution 1803, <br />attached hereto and incorporated by reference herein, denying <br />the rezoning request and development plan; and <br /> <br />WHEREAS, the applicant requested a hearing before the City Council on <br /> his denied application; and <br /> <br />WHEREAS, a public hearing on the rezoning request and Initial Studywas set <br /> for October 23, 1979; and <br /> <br />WHEREAS, <br /> <br />the City Council, at its October 23, 1979, meeting received a <br />staff report, dated October 15, 1979, and an Initial Study, <br />and at a public hearing took testimony from the applicant, his <br />representative, staff and the public. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section <br /> <br />1. Denies without prejudice, the appeal of Amador Valley Inves- <br />tors from a decision of the Planning Commission denying an <br />application to rezone an approximately 8.8 acre site:located <br />east of the existing development on Churchill Drive and south <br />of the extension of Fairlands Drive from the R-1-6500 (Single- <br />Family Residential) District to the PUD (Planned Unit Develop- <br />ment) District, and incorporates by reference, the findings <br />set forth in Resolution 1803 and of the Planning Commission <br />denying the application. <br /> <br />III <br /> <br /> <br />
