CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-238 <br /> <br />A RESOLUTION APPROVING A NEGATIVE DECLARATION FOR <br />THE APPLICATION OF HENRY CUPPLES FOR DEVELOPMENT PLAN <br />APPROVAL FOR A RESTAURANT TO BE LOCATED ON A 0.9 ACRE <br />PORTION OF A 6.1 ACRE SITE LOCATED AT THE SOUTHEAST <br />CORNER OF HOPYARD ROAD AND 1-580 <br /> <br />WHEREAS, <br /> <br />the City Council, at its meeting of November 27, 1979 <br />received a proposed negative declaration for the application <br />for development plan approval for a restaurant to be located <br />on a 0.9 acre portion of a 6.1 acre site located at the south- <br />east corner of Hopyard Road and 1-580 (hereinafter referred <br />to as the Project); and <br /> <br />WHEREAS, <br /> <br />staff has determined that the proposed application for <br />development plan approval is a project for the purposes <br />the California Environmental Quality Act; and <br /> <br />of <br /> <br />WHEREAS, <br /> <br />an Initial Study done pursuant to the Environmental Impact <br />Guidelines and Procedures adopted by the City Council of <br />the City of Pleasanton by Resolution No. 77-66 was prepared <br />for the Project; and <br /> <br />WHEREAS, the City Council, at its meeting of November 27, 1979 also <br /> received that Initial Study dated November 8, 1979; and <br /> <br />WHEREAS, <br /> <br />each member of the City Council had a copy of Resolution <br />No. 77-66 at the time of considering the proposed Negative <br />Declaration and Initial Study; and <br /> <br />WHEREAS, <br /> <br />the public was afforded an opportunity to comment on the <br />proposed environmental assessment, which had been published <br />in the Pleasanton Times, a newspaper of general circulation; <br />and <br /> <br />WHEREAS, <br /> <br />the City Council is aware of the provisions of the City's <br />Guidelines and Processing Procedures for the evaluation of <br />projects and the preparation of Environmental Impact Report <br />as they pertain to requirements for Negative Declarations <br />and Environmental Impact Reports. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. The City Council determines that the proposed application <br /> for development plan approval for a restaurant to be located <br /> on a 0~9 acre portion of a 6.1 acre site located at the south- <br /> east corner of Hopyard Road and 1-580 would not have any sig- <br /> nificant adverse effects on the environment and therefore no <br /> Environmental Impact Report shall be prepared. <br /> <br />III <br /> <br /> <br />
