CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-228 <br /> <br />A RESOLUTION PERMITTING THE TRANSFER OF THE CARD ROOM <br />PERMIT AT 511 MAIN STREET, PLEASANTON <br /> <br />WHEREAS, <br /> <br />the owners of the Pastime Pool Hall, one of two establish- <br />ments in the City of Pleasanton in which the playing of <br />cards is allowed, propose to sell the Pastime Pool Hall <br />and transfer their card room permit to Frank R. Shenave <br />and Jay J. Nelson; and <br /> <br />WHEREAS, the City Ordinance Code requires that the City Council <br /> consent to the transfer of any card room permit; and <br /> <br />WHEREAS <br /> <br />Frank R. Shenave and Jay J. Nelson have requested transfer <br />'to them of the permit for the card room at the 511 Main <br />street, from its previous owners, Pastime Pool, John and <br />Agnes Shaw; and <br /> <br />WHEREAS <br /> <br />at the November 13, 1979, City Council meeting, a report <br />was received from the Assistant to the City Manager recom- <br />mending approval of the transfer; and <br /> <br />WHEREAS <br /> <br />the Police Department has investigated Frank R. Shenave and <br />Jay J. Nelson, the proposed transferees, consistent with <br />the requirements of the Ordinance Code, and has concluded <br />that a permit could be issued to them to operate a card <br />room, thus implying that no basis exists for refusing to <br />permit transfer of the existing permit to Frank R. Shenave <br />and Jay J. Nelson. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves transfering the card room permit at the Pastime <br /> Pool Hall 511 Main Street from John and Agnes Shaw to Frank <br /> R. Shenave and Jay J. Nelson. <br /> <br />Section 2.
