CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-223 <br /> <br />A RESOLUTION APPROVING CONDITIONAL USE PERMIT TO ALLOW <br />THE CONSTRUCTION AND OPERATION OF A MCDONALD'S RESTAURANT <br />ON THE 1.6 ACRE PARCEL LOCATED AT THE NORTHEAST CORNER OF <br />PIMLICO DRIVE AND SANTA RITA ROAD <br /> <br />WHEREAS, <br /> <br />the City Council, at its meeting of November 13, 1979, <br />considered a report, together with attachments, from the <br />Director of Planning and Community Development regarding <br />an application for a conditional use permit to allow the <br />construction and operation of a McDonald's Restaurant on <br />the 1.6 acre parcel located at the northeast corner of <br />Pimlico Drive and Santa Rita Road; and <br /> <br />WHEREAS, <br /> <br />the City Council determined that a Negative Declaration <br />was appropriate for the proposed project and adopted <br />Resolution No. 79-222 approving the Negative Declaration. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves a conditional use permit to allow the construction <br /> and operation of a McDonald's restaurant on the 1.6 acre parcel <br /> located at the northeast corner of Pimlico Drive and Santa Rita <br /> Road, suject to conditions set forth in Exhibit A, and adding <br /> conditions: <br /> <br />(1) <br /> <br />that if the bike trail system be developed on the <br />McDonald's side of Santa Rita Road, that McDonald's <br />is responsible for developing or paying the cost of <br />developing when required by City that portion of the <br />bike trail system in the right-of-way easement owned <br />by the City of Pleasanton; <br /> <br />(2) <br /> <br />that McDonald's pay the cost of adequately signing the <br />north overpass indicating that there is a left turn lane; <br /> <br />(3) that McDonald's be required to provide private guards <br /> as determined by the Police Department to be necessary. <br /> <br />Section 2.
