CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 79-223 A RESOLUTION APPROVING CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION AND OPERATION OF A MCDONALD'S RESTAURANT ON THE 1.6 ACRE PARCEL LOCATED AT THE NORTHEAST CORNER OF PIMLICO DRIVE AND SANTA RITA ROAD WHEREAS, the City Council, at its meeting of November 13, 1979, considered a report, together with attachments, from the Director of Planning and Community Development regarding an application for a conditional use permit to allow the construction and operation of a McDonald's Restaurant on the 1.6 acre parcel located at the northeast corner of Pimlico Drive and Santa Rita Road; and WHEREAS, the City Council determined that a Negative Declaration was appropriate for the proposed project and adopted Resolution No. 79-222 approving the Negative Declaration. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Approves a conditional use permit to allow the construction and operation of a McDonald's restaurant on the 1.6 acre parcel located at the northeast corner of Pimlico Drive and Santa Rita Road, suject to conditions set forth in Exhibit A, and adding conditions: (1) that if the bike trail system be developed on the McDonald's side of Santa Rita Road, that McDonald's is responsible for developing or paying the cost of developing when required by City that portion of the bike trail system in the right-of-way easement owned by the City of Pleasanton; (2) that McDonald's pay the cost of adequately signing the north overpass indicating that there is a left turn lane; (3) that McDonald's be required to provide private guards as determined by the Police Department to be necessary. Section 2. This resolution shall become effective immediately.
