CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-222 <br /> <br />A RESOLUTION APPROVING A NEGATIVE DECLARATION FOR CASE <br />UP-79-14, A CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION <br />AND OPERATION OF A MCDONALD'S RESTAURANT ON THE 1.6 ACRE <br />PARCEL LOCATED AT THE NORTHEAST CORNER OF PIMLICO DRIVE <br />AND SANTA RITA ROAD <br /> <br />WHEREAS, <br /> <br />the City Council at its meeting of November 13, 1979, <br />received a proposed negative declaration for a conditional <br />use permit to allow the construction and operation of a <br />McDonald's restaurant on the 1.6 acre parcel located at <br />the northeast corner of Pimlico Drive and Santa Rita Road <br />(hereinafter referred to as the Project); and <br /> <br />WHEREAS, <br /> <br />staff has determined that the proposed application for a <br />conditional use permit is a project for the purposes of <br />the California Environmental Quality Act; and <br /> <br />WHEREAS , <br /> <br />an Initial Study done pursuant to the Environmental Impact <br />Guidelines and Procedures adopted by the City Council of <br />the City of Pleasanton by Resolution No. 77-66 was prepared <br />for the Project; and <br /> <br />WHEREAS, the City Council, at its meeting of November 13, 1979 also <br /> received that Initial Study dated July 5, 1979; and <br /> <br />WHEREAS, <br /> <br />each member of the City Council had a copy of Resolution <br />No. 77-66 at the time of considering the proposed Negative <br />Declaration and Initial Study; and <br /> <br />WHEREAS, <br /> <br />the public was afforded an opportunity to comment on the <br />proposed environmental assessment, which had been published <br />in the Pleasanton Times, a newspaper of general circulation; <br />and <br /> <br />WHEREAS, <br /> <br />the City Council is aware of the provisions of the City's <br />Guidelines and Processing Procedures for the evaluation of <br />projects and the preparation of Environmental Impact Report <br />as they pertain to requirements for Negative Declarations <br />and Environmental Impact Reports. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. The City Council determines that the proposed Project <br /> would not have any significann adverse effects on the <br /> environment and therefore no Environmental Impact Report <br /> shall be prepared. <br /> <br />Section 2. The City Staff is directed to cause a Notice of Determin- <br /> ation to be filed pursuant to Section 5.4(g) of Resolution No. <br /> 77-66. <br /> <br />III <br /> <br /> <br />
