CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-35 <br /> <br />A RESOLUTION DETERMINING THAT MODEL HOMES WITHIN MULTI- <br />YEAR PHASED PROJECTS BE COUNTED AS UNITS IN THE MULTI- <br />YEAR APPROVAL BUT COUNTING THEM ONLY IN THE YEAR OF <br />OCCUPANCY OR THE LAST YEAR OF THE MULTI-YEAR APPROVAL, <br />WHICHEVER COMES EARILER, UNDER THE RESIDENTIAL ALLOCATION <br />PROGRAM <br /> <br />WHEREAS, <br /> <br />Council received a report from the Director of Planning and <br />Community Development dated February 5, 1980, regarding the <br />question of whether model homes could be built as part of a <br />multi-year phased project without having these units counted <br />in the first phase of development; and <br /> <br />WHEREAS, <br /> <br />although a literal reading of the Residential Allocation <br />Program requirements would not permit such a procedure, the <br />language is sufficiently broad to allow an interpretation <br />that "development approval" of the full three year period <br />was granted and that latitude exists to allow the City <br />Council to allow model home complexes to be built in the <br />first phase in addition to the number specifically allotted; <br />and <br /> <br />WHEREAS, staff indicated that it could prevent abuse of HAP through <br /> the Conditional Use process required for model home projects. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section <br /> <br />1. Model homes in multi-year phased projects shall be <br />counted as units in the multi-year approval, but shall not <br />be counted until the year of occupancy or the last year of <br />the multi-year approval, whichever comes eariler, under the <br />Residential Allocation Program. <br /> <br />Section 2.
