WHEREAS <br /> <br />WHEREAS, <br /> <br />WHEREAS , <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-33 <br /> <br />APPROVING AGREEMENT WITH SOUTHWEST NUCLEAR COMPANY <br />CONCERNING NUCLEAR WASTE STORAGE AT 7066A COMMERCE <br />CIRCLE <br /> <br />the Southwest Nuclear Company applied for and received in <br />1975 a Zoning Certificate from the City of Pleasanton to <br />permit receipt of low-level radioactive waste, for tempo- <br />rary storage until shipping, at 7066A Commerce Circle in <br />the I-G (General Industrial) zone; and <br /> <br />in December, 1975, the Company applied to and received <br />from the Pleasanton Fire Department a hazardous materials <br />permit to store for not more than 30 days the equivalent <br />of one 40-foot trailer van, or 1500 to 2000 cubic feet of <br />low-level radioactive waste; and <br /> <br />on January 28, 1980, the City discovered that Company had <br />in storage three to four truck loads of radioactive material <br />at 7066A Commerce Circle and an additional three to four <br />truck loads of material at 7055A Commerce Circle; and <br /> <br />Southwest Nuclear Company had not applied for either a <br />zoning permit or Fire permit to use 7055A for storage of <br />hazardous materials nor had it requested amendment to the <br />zoning permit or the Fire permit for 7066A Commerce Circle; <br />and <br /> <br />Southwest Nuclear Company has agreed to eliminate its entire <br />inventory at 7055A Commerce Circle and cease use of that site <br />as soon as possible and to eliminate its inventory at 7066A <br />Commerce Circle in excess of the permitted 1500 to 2000 cubic <br />feet, or the equivalent of one 40-foot trailer van load, <br />immediately, and will enter into an agreement with the City <br />to that effect; and <br /> <br />WHEREAS, <br /> <br />at the City Council meeting of February 11, 1980, the City <br />Attorney presented to the Council for review and approval <br />an agreement incorporating the terms agreed to as set forth <br />above; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves the agreement dated February 11, 1980, between <br /> Southwest Nuclear Company and the City of Pleasanton for <br /> compliance within 30 days of the terms set forth in the <br /> agreement. <br /> <br />III <br /> <br /> <br />
