CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-49 <br /> <br />APPROVING THAT THE CITY BE NAMED AS AMICUS IN THREE <br />AMICUS BRIEFS BEING PREPARED BY OTHER CITIES AT NO <br />COST TO PLEASANTON, AND AUTHORIZING AN EXPENDITURE <br />OF $350.00 TO SEND TO THE CITY OF TIBURON <br /> <br />WHEREAS, <br /> <br />the Legal Advocacy Committee of the League of California <br />Cities has recommend a number of appellate cases involving <br />cities for Amicus briefing. Of those, three cases have <br />particular importance to the City of Pleasanton; and <br /> <br />WHEREAS, <br /> <br />the City of Tiburon has requested financial assistance <br />in the preparation of briefs to be presented to the <br />United States Supreme Court in the matter of Agins vs. <br />and <br /> <br />Tiburon; <br /> <br />WHEREAS, the City Attorney recommends that the City send Tiburon <br /> $350.00. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. The City Council hereby approves that the City request <br /> to be named as Amicus and join in the following Amicus <br /> briefs being prepared by other cities at this time with <br /> no cost to the City: <br /> <br />l) <br /> <br />Music Plus Four vs. City of Westminister, an appeal <br />from a trial decision invalidating a drug parapher- <br />nalia ordinance substantially the same as that <br />adopted by the City. <br /> <br />2) <br /> <br />Bownds vs. City of Glendale, a case raising on appeal <br />the legal sufficiency of Glendale's Housing Element, <br />and attempting to have a judicial determination of <br />the controversy relating to the nature of the State <br />Housing Element Guidelines, whether m~ndatory or <br />advisory. <br /> <br />3) <br /> <br />Perez vs. City of San Bruno, an appellate decision <br />challenging a City's right to withold on utility <br />service for non-payment of another utility bill <br />(i.e., no water, if sewer not paid). <br /> <br />Section 2. The City Council hereby authorizes an expenditure of <br /> $350.00 to sent to the City of Tiburon to assist them in <br /> preparing briefs to be presented to the United States <br /> Supreme Court in the matter of A ins vs. Tiburon, relative <br /> to inverse condemnation actions ~or of value due to <br /> loss <br /> down zoning. <br /> <br />III <br /> <br /> <br />
