CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-80 <br /> <br />APPROVING LAVWMA PIPELINE EXPANSION AGREEMENT AND <br />AUTHORIZING CITY OFFICIALS TO EXECUTE THE AGREEMENT <br /> <br />WHEREAS, <br /> <br />at its meeting of March 25, 1980, the City Council received <br />a report dated March 24, 1980, from the City Attorney recom- <br />mending approval of an agreement between the Livermore-Amador <br />Valley Water Management Agency (LAVWMA) and the City of <br />Pleasanton relating to purchase by the City of 500,000 gallons <br />per day of unused capacity in the LAVWMA pipeline; and <br /> <br />WHEREAS , <br /> <br />the Livermore-Amador Valley Water Management Agency was <br />created by a Joint Exercise of powers agreement entered <br />into on June 18, 1974, by the City of Livermore, City of <br />Pleasanton and the Dublin San Ramon Services District for <br />the purpose of selecting and constructing a waste water <br />disposal system for the Livermore-Amador Valley; and <br /> <br />WHEREAS, <br /> <br />the joint exercise of powers agreement was modified on <br />May 31, 1977, to identify the waste water export project <br />selected by LAVWMA; and <br /> <br />WHEREAS, <br /> <br />paragraph XI.A.(8) allows the City of Pleasanton to purchase <br />at least 500,000 gallons per day of unused capacity which <br />may exist on the basic project pipeline, provided it is used <br />for industrial (including non-retail commercial) purposes; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves the agreement between the Livermore-Amador <br /> Valley Water Management Agency (LAVWMA) and the City of <br /> Pleasanton relating to purchase by the City of 500,000 <br /> gallons per day of unused capacity in LAVWMA'a pipeline <br /> for industrial (including non-retail commercial) purposes. <br /> <br />Section 2. Authorizes the appropriate City officials to execute <br /> the agreement. <br /> <br />Section 3. This resolution shall be effective immediately upon its <br /> final passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON MARCH 25, 1980, BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Butler, <br />NOES: None <br />ABSENT: Councilmember Kephart <br />ABSTAIN: None <br /> <br />Mercer, <br /> <br />Wood and Mayor Brandes <br /> <br />III <br /> <br /> <br />
