CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-88 <br /> <br />RESOLUTION AUTHORIZING CITY ATTORNEY TO RESPOND TO <br />ANY APPEAL FILED BY THE DUBLIN SAN RAMON SERVICES <br />DISTRICT IN THE MATTER OF CITY OF PLEASANTON vs. <br />VALLEY COMMUNITY DISTRICT AND RELATED INTERVENTIONS <br /> <br />WHEREAS, <br /> <br />a motion to compel compliance with the judgment in the <br />settlement of the matter of City of Pleasanton vs. <br />Valley Community District and Related Interventions <br />filed on January 11, 1980 has been resolved and <br />judgment entered, which judgment included a settlement <br />agreement regarding allocation of sewer permits; and <br /> <br />WHEREAS, <br /> <br />numerous developers, who are possible beneficiaries <br />of the 1972 Settlement Agreement filed interventions <br />the matter; and <br /> <br />in <br /> <br />WHEREAS, <br /> <br />said developers have moved the Alameda <br />to require the City to comply with the <br />selling sewer permits; and <br /> <br />Superior Court <br />1972 judgment in <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton has offered to compromise its <br />dispute with the property owners to provide sewer <br />capacity as more fully set forth in a Waiver and <br />Compromise Agreement executed by all parties; and <br /> <br />WHEREAS, <br /> <br />Alameda County Superior Court on April 9, 1980 gave a <br />tentative ruling in favor of the developers and the <br />City of Pleasanton and against DSRSD: and <br /> <br />WHEREAS, <br /> <br />it is anticipated that a judgment to that effect adopting <br />the Waiver and Compromise Agreement between the City <br />and its developers will be entered on April 22, 1980; and <br /> <br />WHEREAS, it is expected that DSRSD will appeal the Superior <br /> Court judgment; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Authorizes the City Attorney's office to respond to <br /> any appeal filed by the District in this matter. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
