CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 80-88 RESOLUTION AUTHORIZING CITY ATTORNEY TO RESPOND TO ANY APPEAL FILED BY THE DUBLIN SAN RAMON SERVICES DISTRICT IN THE MATTER OF CITY OF PLEASANTON vs. VALLEY COMMUNITY DISTRICT AND RELATED INTERVENTIONS WHEREAS, a motion to compel compliance with the judgment in the settlement of the matter of City of Pleasanton vs. Valley Community District and Related Interventions filed on January 11, 1980 has been resolved and judgment entered, which judgment included a settlement agreement regarding allocation of sewer permits; and WHEREAS, numerous developers, who are possible beneficiaries of the 1972 Settlement Agreement filed interventions the matter; and in WHEREAS, said developers have moved the Alameda to require the City to comply with the selling sewer permits; and Superior Court 1972 judgment in WHEREAS, the City of Pleasanton has offered to compromise its dispute with the property owners to provide sewer capacity as more fully set forth in a Waiver and Compromise Agreement executed by all parties; and WHEREAS, Alameda County Superior Court on April 9, 1980 gave a tentative ruling in favor of the developers and the City of Pleasanton and against DSRSD: and WHEREAS, it is anticipated that a judgment to that effect adopting the Waiver and Compromise Agreement between the City and its developers will be entered on April 22, 1980; and WHEREAS, it is expected that DSRSD will appeal the Superior Court judgment; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Authorizes the City Attorney's office to respond to any appeal filed by the District in this matter. Section 2: This resolution shall become effective immediately upon its passage and adoption.
