CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-87 <br /> <br />RESOLUTION AUTHORIZING MAYOR TO EXECUTE WAIVER AND <br />COMPROMISE AGREEMENT SIGNED BY DEVELOPERS RELATIVE <br />TO SETTLEMENT OF MOTION TO COMPEL RELATING TO CLAIMS <br />FOR SEWER CAPACITY UNDER THE 1972 SETTLEMENT AGREEMENT <br /> <br />WHEREAS, <br /> <br />a Settlement Agreement was incorporated as part of the <br />judgment entered in the matter of City of Pleasanton <br />v. Valley Community District and Related Interventions, <br />Action No. 423134, Alameda County Superior Court; and <br /> <br />WHEREAS, <br /> <br />attached to that Settlement Agreement was an Exhibit B <br />listing priority of properties to receive sewer permits; <br />and <br /> <br />WHEREAS, <br /> <br />a motion to compel compliance with the judgment in the <br />settlement of the above lawsuit was filed on January 11, <br />1980 by Pleasanton-Foothill 580, Amador Valley Investors <br />and Ponderosa Homes; and <br /> <br />the City of Pleasanton has offered to compromise its <br />dispute with the owners and to provide sewer capacity <br />in amounts more fully set forth in the Waiver and <br />Compromise Agreement; and <br /> <br />WHEREAS, on April 21, 1980, Council reviewed the Waiver and <br /> Compromise Agreement. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Approves the Waiver and Compromise Agreement signed <br /> by the developers relative to the settlement of motion to <br /> compel relating to claims for sewer capacity under the <br /> 1972 Settlement Agreement. <br /> <br />Section 2: Authorizes the mayor to execute the Waiver and Compro- <br /> mise Agreement. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED APRIL 21, 1980 BY THE FOLLOWING VOTE: <br />AYES: Councilmembers - Butler, Mohr and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmembers - Kephart and W <br />ABSTAIN: None <br /> <br /> mes R. <br />By Doris George, Deputy City Clerk <br /> vine, City Attorney <br /> <br /> <br />
