CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-104 <br /> <br />A RESOLUTION OVERRULING OBJECTIONS AND AUTHORIZING STAFF <br />TO PROCEED WITH ABATEMENT OF WEEDS, RUBBISH OR REFUSE <br />UPON OR IN FRONT OF CERTAIN DESCRIBED PROPERTIES WITHIN <br />THE CITY OF PLEASANTON WHICH CONSTITUTE PUBLIC NUISANCES <br /> <br />WHEREAS, the City Council, at its meeting of March 25, 1980, adopted <br /> Resolution No. 80-67 (declaring that weeds, rubbish or refuse <br /> upon or in front of certain described properties within the <br /> City of Pleasanton constitute public nuisances and that the <br /> sa~e shall be abated, and setting a public hearing in regard <br /> to same); and <br /> <br />WHEREAS, <br /> <br />said Resolution No. 80-67 was adopted, pursuant to the <br />provisions of Government Code Sections 39501-39588 setting <br />April 22, 1980, at 8:00 p.m., the Pleasanton City Council <br />Chambers, at the Alameda County Fairgrounds Cafeteria, as <br />the time, date and place to hear and consider objections <br />to the abatement and removal of the weeds, rubbish or refuse <br />upon or in front of certain described properties within the <br />City of Pleasanton as more particularly set forth in Exhibit <br />A to Resolution No. 80-67; and <br /> <br />WHEREAS, <br /> <br />the City Council held a public hearing on April 22, 1980, <br />on the proposed removal of weeds, rubbish and refuse and <br />the hearing was closed on April 22, 1980; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. The City Council elects to proceed under the provisions <br /> of Government Code Sections 39501-39588 to remove weeds, <br /> rubbish or refuse upon or in front of certain described <br /> properties within the City of Pleasanton as more particularly <br /> set forth in Exhibit A to Resolution No. 80-67. <br /> <br />Section 2. The Fire Prevention officer is ordered to abate the <br /> nuisance declared by Resolution No. 80-67, by having the <br /> weeds, rubbish and refuse removed and, for this purpose, <br /> the Fire Prevention officer may enter upon private pro- <br /> perty to abate the nuisance. Before the Fire Prevention <br /> officer arrives, any property owner may remove the weeds, <br /> rubbish or refuse at his own expense. <br /> <br />Section <br /> <br />3. The Fire Prevention officer or the contractor awarded <br />the work by the City for removal of weeds, rubbish or <br />refuse, as the case may be, shall keep an account of the <br />cost of abatement in front of or on each separate parcel <br />of land where the work is done and shall submit to the <br />City Council for consideration, hearing of objections <br />modification and confirmation, and itemized written reports <br /> <br />III <br /> <br /> <br />
