CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-126 <br /> <br />APPROVING INSTALLATION OF AUTOMATIC RAILROAD PROTECTION <br />GATES AT BERNAL AVENUE AND WESTERN PACIFIC RALROAD AND <br />AMENDING THE 1979-80 BUDGET ACCORDINGLY <br /> <br />WHEREAS, <br /> <br />the City Council, at it meeting of May 13, 1980, received <br />a report from the Director of Engineering Services dated <br />May 5, 1980, indicating that the City had in 1978, requested <br />installation of automatic gates at Bernal Avenue, West Angela <br />Street and Rose Avenue along the Western Pacific Railroad; <br />and <br /> <br />WHEREAS, <br /> <br />since the City later had assurance from the railroad companies <br />that they would soon be completing their consolidation agree- <br />ment which would include plans for an undercrossing on Bernal <br />Avenue, thereby eliminating the need for the automatic gates <br />on Bernal Avenue; and <br /> <br />WHEREAS, <br /> <br />because the consolidation of the railroad companies does not <br />now appear to be imminent and the Bernal Avenue crossing is <br />a dangerous crossing, the Director of Engineering Services <br />recor~nended in his report dated May 5, 1980, that the Council <br />approve installation of the automatic gates at this time and <br />amend the 1979-80 budget accordingly; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves installation of automatic railroad protection <br /> gates at Bernal Avenue and Western Pacific Railroad and <br /> amending the 1979-80 Budget by $5,000 for this installation. <br /> <br />Section 2. Staff is hereby instructed to request the Western Pacific <br /> Railroad Company to pay the City's share for the project and, <br /> in the event they refuse, ask the Public Utilities Commission <br /> to reimburse the City. <br /> <br />Section 3.
