CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-160 <br /> <br />A RESOLUTION AUTHORIZING THE CITY ATTORNEY'S OFFICE TO <br />ASK ALAMEDA COUNTY COUNSEL TO PROVIDE DEFENSE IN THE <br />CASE OF SAFEWAY STORES, INC. v. COUNTY OF ALAMEDA, CITY <br />OF PLEASANTON, et al <br /> <br />WHEREAS, <br /> <br />a complaint was served on the City of Pleasanton on May 20, <br />1980, in the matter of Safeway Stores, Inc. v. County of <br />Alameda, City of Pleasanton, et al, (Case No. 523248-2) for <br />a refund of taxes assessed and collected; and <br /> <br />WHEREAS, <br /> <br />Revenue and Taxation Code §5148 provides that defense of <br />such actions can be provided by the counsel for the County <br />or the counsel for the City; and <br /> <br />WHEREAS , <br /> <br />at its meeting of June 10, 1980, the City Council received <br />a report from the City Attorney, dated May 29, 1980, recom- <br />mending that he be authorized to formally request the County <br />to provide defense in this law suit; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section <br /> <br />1~ Authorizes the City Attorney to formally request Alameda <br />County Counsel to provide defense in the lawsuit filed by <br />Safeway Stores, Inc. v. County of Alameda, City of Pleasanton <br />et al, (Case No. 523248-2). <br /> <br />Section 2.
