CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 80-158 APPROVING THE APPEAL OF DENNIS AVAKIAN et al, OF A DECISION OF THE BOARD OF ADJUSTMENT DENYING WITHOUT PREJUDICE THEIR APPLICATION FOR A VARIANCE FROM THE PARKING AND SETBACK REQUIREMENTS OF THE ORDINANCE CODE WHEREAS, Dennis Avakian applied to the Board of Adjustment for a variance from the parking and setback requirements of the Ordinance Code to allow the construction of two additional dwelling units at 4578 Augustine Street; and WHEREAS, the Board of Adjustment at its meeting of May 14, 1980, considered the application together with the Staff Report regarding this matter; and WHEREAS, the Board of Adjustments denied without prejudice Mr. Avakian's application; and WHEREAS, within the time specified by the Ordinance Code of the City of Pleasanton, the applicant submitted an appeal to the City Clerk of the City of Pleasanton; a~d WHEREAS, the City Council at its meeting of June 10, 1980, received a report dated June 3, 1980, from the Director of Planning and Community Development together with a copy of the Staff Report to the Board of Adjustment regarding this matter; and WHEREAS, the City Council held a public hearing at which time appli- cant and any other member of the public was offered an opportunity to present evidence regarding this appeal; and WHEREAS, upon close of public hearing, the City Council deliberated on this appeal; NOW, THEREFORE, THE CITY COUNCIL OF ,THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Approves the appeal of Dennis Avakian, et al, of a decision of the Board of Adjustment denying without prejudice his application for a variance from the parking and setback requirements of the Ordinance Code to allow the construction of two additional dwelling units at 4578 Augustine Street. Section 2. The City Council hereby adopts the findings as to setbacks and variances set forth in Exhibit A attached hereto and incorporated herein by reference. III
