CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-158 <br /> <br />APPROVING THE APPEAL OF DENNIS AVAKIAN et al, OF A <br />DECISION OF THE BOARD OF ADJUSTMENT DENYING WITHOUT <br />PREJUDICE THEIR APPLICATION FOR A VARIANCE FROM THE <br />PARKING AND SETBACK REQUIREMENTS OF THE ORDINANCE <br />CODE <br /> <br />WHEREAS, <br /> <br />Dennis Avakian applied to the Board of Adjustment for a <br />variance from the parking and setback requirements of the <br />Ordinance Code to allow the construction of two additional <br />dwelling units at 4578 Augustine Street; and <br /> <br />WHEREAS, <br /> <br />the Board of Adjustment at its meeting of May 14, 1980, <br />considered the application together with the Staff Report <br />regarding this matter; and <br /> <br />WHEREAS, the Board of Adjustments denied without prejudice Mr. <br /> Avakian's application; and <br /> <br />WHEREAS, <br /> <br />within the time specified by the Ordinance Code of the <br />City of Pleasanton, the applicant submitted an appeal to <br />the City Clerk of the City of Pleasanton; a~d <br /> <br />WHEREAS, <br /> <br />the City Council at its meeting of June 10, 1980, received <br />a report dated June 3, 1980, from the Director of Planning <br />and Community Development together with a copy of the Staff <br />Report to the Board of Adjustment regarding this matter; and <br /> <br />WHEREAS, <br /> <br />the City Council held a public hearing at which time appli- <br />cant and any other member of the public was offered an <br />opportunity to present evidence regarding this appeal; and <br /> <br />WHEREAS, upon close of public hearing, the City Council deliberated <br /> on this appeal; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF ,THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves the appeal of Dennis Avakian, et al, of a <br /> decision of the Board of Adjustment denying without <br /> prejudice his application for a variance from the parking <br /> and setback requirements of the Ordinance Code to allow <br /> the construction of two additional dwelling units at <br /> 4578 Augustine Street. <br /> <br />Section 2. The City Council hereby adopts the findings as to <br /> setbacks and variances set forth in Exhibit A attached <br /> hereto and incorporated herein by reference. <br /> <br />III <br /> <br /> <br />
