CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-177 <br /> <br /> A RESOLUTION AMENDING RESOLUTION NO. 80-122 (A RESOLUTION <br /> AGREEING TO THE EXCHANGE OF PROPERTY TAX REVE~E FOR <br /> ANNEXATION NO. 78 (FROM}{)) <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON HEREBY RESOLVES TO AMEND <br />RESOLUTION NO. 80-122 (A RESOLUTION AGREEING TO THE EXCHANGE OF <br />PROPERTY TAX REVENUE FOR ~IqNEXATION NO. 78 (FROMM)) IN ITS ENTIRETY <br />AS FOLLOWS: " <br /> <br />WHEREAS, on May 13, 1~'80, the City Council adopted Resolution No. <br /> 80-121, declaring no protest and o~dering annexation of <br /> area designated as Annexation No. 78; and <br /> <br />WHEREAS, <br /> <br />Section 99 of the Revenue and Taxation Code (AB 8) provides, <br />among other things, that no local agency jurisdictional <br />change can be completed without the agencies affected by <br />such change first having agreed upon an exchange of property <br />tax revenue between and among the affected agencies; and <br /> <br />the Alameda County Mayors' Conference, the City of <br />Pleasanton (Resolution No. 80-74) and the Alameda County <br />Board of Supervisors (Resolution No. 186574) have agreed to <br />a method for equitably distributing the property taxes; and <br /> <br />WHEREAS, <br /> <br />such specific annexation needs a resolution from both the <br />City and County agreeing to the exchange of property tax <br />revenues for the annexation to be completed and filed with <br />the State; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. That for annexation No. 78 by the City of Pleasanton, <br /> which will be first effective for the fiscal year following <br /> filing of the Certificate of Completion with the State Board <br /> of Equalization providing the filing occurs prior to December <br /> 31 of the preceding year, the Auditor-Controller of Alameda <br /> County shall be directed to causean exchange of property <br /> tax revenues pursuant to the provisions of paragraphs Nos. <br /> 1 or 2, and 3 of the attached City Council Resolution No. <br /> 80-74, approving a policy for distributing tax revenues. <br /> <br />Section 2. That the property tax proceeds accruing for the Structural <br /> Fire Fund shall be transferred to the City of Pleasanton. <br /> <br />Section 3o This resolution shall become effective immediately upon <br /> its passage and adoption. <br /> <br />III <br /> <br /> <br />
