CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-196 <br /> <br />RESOLUTION DENYING THE REQUEST OF FORMER FIRE <br />CAPTAIN BERT CHERRY <br /> <br />Bert Cherry, formerly a member of the City of Pleasanton <br />Fire Department, made a claim for back pay in the amount <br />of $15,374.65; and <br /> <br />WHEREAS, that claim was denied by the City Manager by letter <br /> dated June 13, 1980; and <br /> <br />WHEREAS, Mr. Cherry requested the City Council to review his <br /> claim; and <br /> <br />WHEREAS, the City Council on July 8, 1980 and on July 22, 1980 <br /> reviewed Mr. Cherry's claims. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. To deny the claim of Mr. Cherry for back pay as <br /> there is no legal basis upon which to grant back pay. <br /> <br />Section 2. Authorizes the mayor to communicate the denial to <br /> Mr. Cherry. <br /> <br />Section 3. This resolution shall be effective immediately upon <br /> its final passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON JULY 22, 1980, BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Butler, Kephart, Mohr, Wood and <br /> Mayor Mercer <br />NOES: None <br />ABSENT:: None <br /> <br />~nf <br /> <br /> <br />
