CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-254 <br /> <br />RESOLUTION APPROVING QUITCLAIM OF EASEMENTS AND <br />SURFACE ENTRY RIGHTS IN TRACT 4549, WELLINGTON <br />CONDOMINIUMS. <br /> <br />WHEREAS, <br /> <br />a Quitclaim Deed from Morrison Homes Corporation to the <br />City of Pleasanton regarding subterranean water, without <br />rights of surface entry, in Tract 4549 was presented <br />for the review and approval of the Council; and <br /> <br />WHEREAS, <br /> <br />for the purpose of extinguishing surface entry rights <br />for the extraction of water, a Quitclaim Deed was <br />prepared for execution by the City of Pleasanton to <br />Morrison Homes Corporation and presented to the Council <br />for review; and <br /> <br />WHEREAS~,.the City 9f Pleasanton no longer requires that easement <br /> recorded on October 24~ 1978 in Reel 5639, Image 390, <br /> Alameda County Records and therefore a Quitclaim Deed <br /> from the City to Morrison Homes Corporation has been <br /> prepared and presented to the Council for review; and <br /> <br />WHEREAS, an easement for public utility purposes is being conveyed <br /> to the City from Morrison Homes Corporation and a Quit- <br /> claim Deed for that purpose was also presented to the <br /> Council for review. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1. The Quitclaim Deed from Morrison Homes Corporation <br /> to the City of Pleasanton regarding subterranean water, <br /> without rights of surface entry, in Tract 4549 is <br /> approved and accepted by the City Council. <br /> <br />Section 2. The Quitclaim Deed from the City of Pleasanton to <br /> Morrison Homes Corporation extinguishing surface entry <br /> rights for extraction of water in Tract 4549 is approved <br /> and the appropriate city officials are authorized to <br /> execute the same. <br /> <br />Section 3. The Quitclaim Deed from the City of Pleasanton to <br /> Morrison Homes Corporation regarding the easement <br /> recorded October 24, 1978 in Reel 5639, Image 390, <br /> Alameda County Records is approved and the appropriate <br /> city officials are authorized to execute the same. <br /> <br />Section 4. The Quitclaim Deed from Morrison Homes Corporation <br /> to the City of Pleasanton for a public utilities easement <br /> is approved and accepted by the City Council. <br /> <br /> <br />
