CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 80-250 RESOLUTION APPROVING AMENDED AGREEMENT BETWEEN CITY OF PLEASANTON AND WILLOW WEST PROPERTIES FOR INDUSTRIAL AND NON-RETAIL COMMERCIAL SEWAGE CAPACITY AND DEVELOP- MENT OF THE WILLOW WEST PROPERTY the City of Pleasanton and Willow West Properties entered into an agreement dated July 24, 1979, which included a specific reservation of 200,000 gallons per day (GPD) of sewage capacity for approximately 360 acres of industrial zoned property located in the City; and WHEREAS, Willow West Properties notified the City in late 1979 that they had been working with Prudential Insurance Company of America for development of an industrial park on the 360 acres, but that the 200,000 GPD reserve was insufficient sewage capacity to start the project; and WHEREAS, at the February 26, 1980 Council meeting, staff was instructed to re-evaluate the existing contract with Willow West Properties; and WHEREAS, during the re-evaluation process, five additional applications were made from other developers for a portion of the capacity created by the expansion of the DSRSD plant; and WHEREAS, on September 23, 1980, City Council reviewed each of the six projects and concluded that Willow West Properties ranked first in eligibility for sewer capacity; and WHEREAS, after exhaustive research and negotiations with repre- sentatives of Willow West Properties and Prudential Insurance Company of America, an Amended Agremenet was drafted; and WHEREAS, City Council reviewed the Amended Agreement at a special meeting of the Council on September 29, 1980. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the Amended Agreement between the City of Pleasanton and Willow West Properties regarding industrial and non-retail commercial.sewage .capacity and development of the Willow West property. Section 2: Authorizes theappropr:~ate'City officials to execute said agreement.
