CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-279 <br /> <br />RESOLUTION ESTABLISHING MINIMUM PERCENTAGE OF <br />LOWER-INCOME UNITS FOR RAP ELIGIBILITY <br /> <br />WHEREAS, <br /> <br />Section 2-20.05 of the Residential Allocation Program <br />Ordinance of the City of Pleasanton authorizes the <br />exemption from its project selection requirements for <br />projects designated as lower-income housing; and <br /> <br />WHEREAS, <br /> <br />Council requested the City Attorney to investigate the <br />problem of the minimum percentage of lower-income units <br />needed to qualify a mixed project for the RAP exemption; <br /> <br />WHEREAS, <br /> <br />Council received staff and public input relative to the <br />minimum number of units a mixed project must contain <br />in order to be eligible for the RAP lower-income housing <br />exemption; and <br /> <br />WHEREAS, <br /> <br />Council wishes to establish a policy for qualifying <br />mixed projects in order to assist project sponsors in <br />planning and developing such housing. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: In no case should the exemption be granted to any <br /> mixed project with less than 0% lowersincome units. <br /> <br />Section 2: Subsidized projects utilizing the RAP lower-income <br /> housing exemption shall have at least 50% lower-income <br /> housing units unless the project sponsor can show that <br /> the available subsidies are only available for lower- <br /> income projects having a smaller percentage of lower- <br /> income units and that the project contains the largest <br /> proportion of lower-income units attainable. <br /> <br />Section 3: Non-subsidized projects utilizing the RAP lower-income <br /> exemption shall have at least 50% lower-income units <br /> unless the project sponsor can show that the project <br /> as a whole is economically unviable with 50% of its <br /> units available to lower-income households and that <br /> the smaller percentage (but still above the 20% floor) <br /> is the maximum proportion of lower-income units <br /> economically attainable. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
