CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-315A <br /> <br />RESOLUTION APPROVING STIPULATED SETTLEMENT OF <br />CITY OF PLEASANTON vs. WESTERN PACIFIC RAILROAD <br />COMPANY AND AMENDING BUDGET <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton filed a complaint in eminent <br />domain, Action No. H-55396-6, in order to acquire <br />approximately 0.77+ acres of permanent easement across <br />the land of the WeTtern Pacific Railroad Company <br />commonly described as Alameda County Assessor's Parcel <br />946-3630-5 and a temporary construction easement <br />adjacent to said permanent easement; and <br /> <br />WHEREAS, <br /> <br />Western Pacific Railroad Company and the City of <br />Pleasanton have negotiated a stipulated judgment <br />settling the matter for the approximate appraised <br />values of said easements. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Authorizes the filing in the Alameda Superior Court <br /> of a stipulated judgment between the City of Pleasanton <br /> and Western Pacific Railroad Company by which the City <br /> of Pleasanton shall pay $26,200, plus interest at 7% <br /> to the date of judgment for said lands. <br /> <br />Section 2: Authorizes amending the budget of the City of <br /> Pleasanton to provide for any additional money necessary <br /> to pay for said easements. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED DECEMBER 9, 1980 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers Butler, Kephart, Mohr, and Mayor Mercer <br />NOES: None ~t-~ <br />ABSEI~: Councilmember Wood <br /> <br /> RCER. <br /> Wal~er,~ Clerk ~ <br /> <br />By Doris George, Deputy City Clerk <br />APPROVED AS TO FORM: <br /> <br />City Attorney <br /> <br /> <br />
