CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-310 <br /> <br />RESOLUTION DENYING APPEAL OF THE CITY COUNCIL OF THE <br />DECISION OF THE BOARD OF ADJUSTMENT APPROVING THE <br />APPLICATION OF SOUTHLAND CORPORATION FOR A VARIANCE <br />FROM THE REQUIREMENTS OF SECTION 2-9.43(a), ARTICLE <br />18, CHAPTER 2, TITLE II OF THE ORDINANCE CODE OF THE <br />CITY OF PLEASANTON <br /> <br />WHEREAS, <br /> <br />at their meeting of November 17, 1980, the Board of <br />Adjustment approved the application of Southland <br />Corporation for a variance allowing the installation <br />of a free-standing sign at 3760 Hopyard Road on a <br />parcel which is less than three acres in size; and <br /> <br />WHEREAS, this matter was appealed by the City Council; and <br /> <br />WHEREAS, the matter was considered by the City Council on <br /> December 9, 1980 and was open to a public hearing. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The Council adopts the following general findings <br /> for variances: <br /> <br />That because of specific circumstances relating <br />to the placement of the building on the site in a <br />location where the surrounding businesses are <br />closer to the street than the building, strict <br />application of the provisions of the zoning code <br />would deprive the property owner of easy visibility <br />from the street and privileges embraced by other <br />property owners in the C-N Zones. <br /> <br />Because of the location of the site granting of a <br />free-standing sign for the applicant does not <br />constitute a grant of special privilege. <br /> <br />The granting of the variance will not be detrimental <br />to the public health, safety and welfare in that <br />it will increase the safety of those attempting <br />to find the site by providing earlier identification <br />of the driveway and business; and <br /> <br />the additional findings required for signs are made by <br />the City Council as follows: <br /> <br />the granting of the variance will not detract from <br />the attractiveness or orderliness of the city's <br />appearance in that the design and size of the <br /> <br /> <br />
