CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 81-28 RESOLUTION APPROVING LETTER AGREEMENT WITH EARL ADAMS AND JOSEPH E.MADDEN REGARDING "SHADOW CREEK" PROJECT/LOW-INCOME HOUSING AGREEMENT WHEREAS, at the June 24, 1980 meeting of the City Council, unanimous approval of the Development Plan for the 48-unit multiple family project on Vineyard Avenue, called "Shadow Creek" was granted; and WHEREAS, WHEREAS, on November 24, 1980 Council determined that the project would not have a negative impact on the Residential Allocation Program or on the area of the City in which the project is located; and developer agr'ees to cormnit 29% or 10 units of the planned development/tb low~income people under certain conditions-enumerated in the attached agreement; and WHEREAS, the City Council reviewed the attached agreement at its meeting on February 10, 1981; and WHEREAS, the proposed agreement meets the requirements of the lower-income housing exemption of the Residential Allocation Program. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Approves and accepts the letter agreement executed by Earl Adams and Joseph E. Madden dated February 10, 1981 regarding Low-Income Housing at "Shadow Creek" which is attached hereto and incorporated by reference herein. Section 2: Agrees that in consideration for the promises set forth in the attached letter, the "Shadow Creek" project is hereby exempted from RAP as a "lower-income project." Section 3: This resolution shall become effective immediately upon its passage and adoption.
