CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-27 <br /> <br />RESOLUTION APPROVING APPLICATION OF ROBERT AND <br />MARGARET STARNS FOR SEPTIC TANK PERMIT AT 5050 <br />FOOTHILL ROAD <br /> <br />WHEREAS, <br /> <br />City Council of the City of Pleasanton Resolution No. <br />79-37 granted approval of a septic tank application <br />by Harry Hempy to build a house on the property <br />adjacent to his address at 5000 Foothill Road; and <br /> <br />WHEREAS, <br /> <br />Mr. Harry Hempy in fact constructed the house and <br />septic tank pursuant to the septic tank agreement; <br />and <br /> <br />WHEREAS, Mr. Harry Hempy intends to sell the property to <br /> Robert and Margaret Starns; and <br /> <br />WHEREAS, the agreement entered into pursuant to Resolution No. <br /> 79-37 required city consent prior to assignment.; and <br /> <br />WHEREAS, <br /> <br />Resolution No. 79-37 and the agreement incorrectly <br />described the address and parcel number of the property <br />subject to the agreement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: To approve the assignment and transfer of the Septic <br /> Tank approval issued pursuant to Resolution No. 79-37 <br /> to Robert and Margaret Starns for the property at 5050 <br /> Foothill Road, Pleasanton, California being Alameda <br /> County Parcel Number 941-1980-3-12. <br /> <br />Section 2: The City Attorney is directed to prepare and the Mayor <br /> is authorized to execute on behalf of the City a <br /> standard septic tank agreement pursuant to the provisions <br /> set forth in Resolution No. 73-139. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED FEBRUARY 10, 1981 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers Butler, Kephart, Mohr, Wood and Mayor Mercer <br /> <br />/W~ ~ ~' ' '' YORe s~~ <br /> l~y Cle <br /> By Doris George, Deputy City Clerka~rv%~ _/~ <br /> y E. eE.~e~ine, City Attorney <br /> <br /> <br />
