CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-58 <br /> <br />RESOLUTION APPROVING APPLICATION OF BILLY NEWMAN <br />FOR A SEPTIC TANK PERMIT AT 5130 FOOTHILL ROAD <br /> <br />Mr. Billy Newman desires to build a single-family <br />residence on approximately 3.36 acres of land at <br />5130 Foothill Road, Assessor's Parcel 941-1980-2; and <br /> <br />WHEREAS, <br /> <br />there is presently no sewer service available for this <br />area and Mr. Newman has made application for a permit <br />to construct a septic tank on said property; and <br /> <br />WHEREAS, <br /> <br />the City Council on August 6, 1973, adopted Resolution <br />No. 73-139 (A Resolution Establishing a Policy Regarding <br />the Use of Septic Tanks within the City of Pleasanton); <br />and <br /> <br />WHEREAS, <br /> <br />at their meeting of March 10, 1981, the City Council <br />received and considered the report of the Associate <br />Civil Engineer dated March 3, 1981, which indicated <br />that Mr. Newman's application and the property met most <br />of the criteria set forth in Resolution No. 73-139. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Approves the septic tank application of Billy Newman <br /> for construction of a septic tank on the approximately <br /> 3.36 acres of land at 5130 Foothill Road, Assessor's <br /> Parcel 941-1980-2, subject to the following conditions: <br /> <br />(1) That the dwelling be connected to a public sewer <br /> as soon as permissible. <br /> <br />(2) That the dwelling be connected to a public water <br /> supply for its potable water. <br /> <br />(3) <br /> <br />That the applicant enter into a standard septic <br />tank agreement with the City prior to issuance <br />of a building permit on this site. Approval of <br />this application should also constitute authori- <br />zation for execution of this septic tank agreement <br />by the proper City officials. <br /> <br />(4) That the requirements and conditions of the Alameda <br /> County Health Department be fully complied with. <br /> <br />Section 2: The City Attorney is directed to prepare and the Mayor <br /> is authorized to execute on behalf of the City a standard <br /> septic tank agreement pursuant to the provisions set forth <br /> in Resolution No. 73-139 and the conditions contained in <br /> Section 1. <br /> <br /> <br />
