CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-53 <br /> <br />A RESOLUTION ESTABLISHING CITY ENFORCEMENT OF <br />HANDICAPPED PARKING SPACE REGULATIONS <br /> <br />WHEREAS, <br /> <br />state law makes it unlawful to park in handicapped <br />parking spaces unless the parked vehicle displays <br />the required placards given to the handicapped; and <br /> <br />WHEREAS, <br /> <br />enforcement of the state law in public and private <br />parking facilities requires appropriate city and <br />private facility owner actions; and <br /> <br />WHEREAS, <br /> <br />City Council in 1980 took action to establish public <br />enforcement of handicapped stall violations in most <br />of the commercial parking lots in the city; and <br /> <br />WHEREAS, <br /> <br />handicapped parking stalls are being used by the non- <br />handicapped, to the detriment of bona fide handicapped <br />persons; and <br /> <br />WHEREAS, <br /> <br />the City Council has received a recommendation of the <br />Human Resources Commission urging the Council to do <br />its share to make enforcement possible. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Instructs staff to return with a report recommending <br /> possible locations to be designated as on-street handi- <br /> capped parking spaces together with proposed day and <br /> hour restrictions, if any. <br /> <br />Section 2: Establishes in each public parking facility under the <br /> jurisdiction of the City of Pleasanton handicapped parking <br /> spaces in an amount and location deemed appropriate by <br /> the City Manager and instructs the City Manager to have <br /> affixed the appropriate signs required by state law to <br /> allow vehicles violating the handicapped stall regulations <br /> to be ticketed and/or towed. <br /> <br />Section 3: Urges private parking lot operators of those parking <br /> facilities enumerated in Council Resolution 80-267 to <br /> post the necessary signs to allow City enforcement of <br /> the handicapped parking space regulations. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
