CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 81-42 RESOLUTION APPROVING TWO AMENDMENTS TO THE SEWER SERVICE CONTRACT BETWEEN LAVWMA AND THE CITY OF PLEASANTON WHEREAS, a Sewer Service Contract between Livermore-Amador Valley Water Management Agency (LAVWMA) and the individual member agencies was executed in 1978 which included the estimated percentage of total cost of the LAVWMA Project that was the responsibility of each agency; and WHEREAS, upon completion of the project when actual costs were known, the actual percentage costs were to replace the estimates; and WHEREAS , in addition to the reallocated costs, the contract was to include the revised flows as a result of the 1.0 MGD industrial capacity; and WHEREAS, the computations of the former LAVWMA manager did not take into consideration the court order which increased Pleasanton's flow and reduced DSRSD's flow by .257 MGD. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the amendment of Section 4.01 of the Sewer Service Contract so that the Fixed Cost Allocation for each Member shall be as follows: For Livermore, 49.6%; for Pleasanton, 28.71%; and for DSRSD, 21.67%. Section 2: Approves the amendment of Section 3.03 of the Sewer Service Contract so that the maximum sewer service required to be provided to each Member shall be as follows: For Livermore, 7.02 mgd (Actual Flow 8.424); for Pleasanton, 5.63 mgd (Actual Flow 6.756); and for DSRSD, 3.97 mdg (Actual Flow 4,764). Section 3: This resolution shall become effective immediately upon its passage and adoption. THIS RESOLUTION ADOPTED FEBRUARY 10, 1981 BY THE FOLLOWING VOTE:
