CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-42 <br /> <br />RESOLUTION APPROVING TWO AMENDMENTS TO THE SEWER <br />SERVICE CONTRACT BETWEEN LAVWMA AND THE CITY OF <br />PLEASANTON <br /> <br />WHEREAS, <br /> <br />a Sewer Service Contract between Livermore-Amador <br />Valley Water Management Agency (LAVWMA) and the <br />individual member agencies was executed in 1978 <br />which included the estimated percentage of total <br />cost of the LAVWMA Project that was the responsibility <br />of each agency; and <br /> <br />WHEREAS, <br /> <br />upon completion of the project when actual costs were <br />known, the actual percentage costs were to replace the <br />estimates; and <br /> <br />WHEREAS , <br /> <br />in addition to the reallocated costs, the contract <br />was to include the revised flows as a result of the <br />1.0 MGD industrial capacity; and <br /> <br />WHEREAS, <br /> <br />the computations of the former LAVWMA manager did not <br />take into consideration the court order which increased <br />Pleasanton's flow and reduced DSRSD's flow by .257 MGD. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section <br /> <br />1: Approves the amendment of Section 4.01 of the Sewer <br />Service Contract so that the Fixed Cost Allocation for <br />each Member shall be as follows: For Livermore, 49.6%; <br />for Pleasanton, 28.71%; and for DSRSD, 21.67%. <br /> <br />Section 2: Approves the amendment of Section 3.03 of the Sewer <br /> Service Contract so that the maximum sewer service <br /> required to be provided to each Member shall be as <br /> follows: For Livermore, 7.02 mgd (Actual Flow 8.424); <br /> for Pleasanton, 5.63 mgd (Actual Flow 6.756); and <br /> for DSRSD, 3.97 mdg (Actual Flow 4,764). <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED FEBRUARY 10, 1981 BY THE FOLLOWING VOTE: <br /> <br /> <br />
