CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION N0. 81-78 <br /> <br />APPROVING OLD SANTA RITA ROAD SANITARY SEWER <br />REIMBURSEMENT AGREEMENT WITH ADAMS, MADDEN AND <br />HANK COMPANY <br /> <br />WHEREAS, <br /> <br />Earl and Barbara Adams, Joseph Madden, and the Hank <br />Company have paid for the construction of a sanitary <br />sewer main extension in Old Santa Rita Road, which <br />can serve other properties in the area; and <br /> <br />WHEREAS, <br /> <br />by the reimbursement agreement (a copy of which is <br />attached) those who paid for the sewer are asking the <br />City to collect a proportionate share of the cost of <br />the sewer from owners of property who connect to the <br />sewer in the future; and <br /> <br />WHEREAS, <br /> <br />a copy of the agreement and notice of the hearing on <br />this matter have been sent to all property owners who <br />would be affected by the agreement; and <br /> <br />WHEREAS, <br /> <br />a public hearing was held on March 24, 1981 at which <br />time the affected parties were given an opportunity <br />to comment on the proposed agreement; and <br /> <br />WHEREAS, <br />WHEREAS, <br /> <br />staff has reviewed the agreement and considers the <br />proposed cost distribution equitable; and <br /> <br />Council has reviewed the proposed reimbursement agreement <br />and the report of the Director of Public Works and <br />Utilities dated March 17, 1981. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section <br /> <br />1: Approves the Reimbursement Agreement with Earl and <br />Barbara Adams, Joseph Madden and Hank Company regarding <br />the Old Santa Rita Road sanitary sewer. <br /> <br />Section 2: Authorizes the appropriate City Officials to execute <br /> the agreement. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED MARCH 24, 1981 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Kephart, Mohr, Wood and Mayor Mercer <br />NOES: None <br /> <br /> <br />
