CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-72 <br /> <br />ACCEPTANCE OF GRANT DEEDS FROM JACK C. FIORIO FOR <br />THE CONSTRUCTION!OF PETERS AVENUE <br /> <br />WHEREAS, <br /> <br />the Alameda County Right-of-Way Department has succeeded <br />in acquiring on behalf of the City of Pleasanton two <br />parcels of land from Jack C. Fiorio; and <br /> <br />WHEREAS, this land is necessary for the construction of Peters <br /> Avenue from Rose Avenue to Bernal Avenue; and <br /> <br />WHEREAS, <br /> <br />when the City purchased the old Catholic Church Rectory <br />site, there was a portion of excess land remaining <br />after Peters Avenue was constructed; and <br /> <br />WHEREAS, <br /> <br />inasmuch as this land is unbuildable due to its size <br />(approximately 7 ft. wide by 96 ft. long) and is <br />adjacent to Jack Fiorio's mother's property, it is <br />appropriate that they should have ownership; and <br /> <br />WHEREAS, in lieu of the cash payment of $3,675.00 as reported in <br /> the appraisal, a trade was negotiated; and <br /> <br />WHEREAS, staff has reviewed the documents and finds everything <br /> to be in order; and <br /> <br />WHEREAS, <br /> <br />at their meeting of March 24, 1981, the City Council <br />reviewed a report from the Director of Public Works <br />and Utilities indicating that the acceptance of these <br />Grant Deeds are in the public interest. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Authorizes acceptance of two Grant Deeds from Jack C. <br /> Fiorio and his wife, Patricia A. Fiorio to the City of <br /> Pleasanton for purposes of constructing Peters Avenue. <br /> <br />Section 2: Authorizes the City Manager to execute the two Certifi- <br /> cates of Acceptance of Real Property. <br /> <br />Section 3: Authorizes the Mayor to execute a Grant Deed to <br /> Lillie M. Fiorio, a widow, in lieu of a cash payment <br /> for the above easements. <br /> <br />Section 4: Authorizes the Director of Public Works and the Mayor <br /> to execute the Real Property Purchase Contract. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
