CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-71 <br /> <br />RESOLUTION DECLARING TEAT WEEDS, RUBBISH OR REFUSE <br />UPON OR IN FRONT OF CERTAIN DESCRIBED PROPERTIES <br />WITHIN THE CITY OF PLEASANTON CONSTITUTE PUBLIC <br />NUISANCES AND TEAT THE SAME SHALL BE ABATED, AND <br />SETTING A PUBLIC HEARING IN REGARD TO SAME <br /> <br />WHEREAS, <br /> <br />there is attached hereto and incorporated by reference <br />herein as if fully set forth, a list of properties to <br />which the declaration herein applies; and <br /> <br />WHEREAS, <br /> <br />said list of properties specifically sets forth street, <br />lot and block numbers according to the official assess- <br />ment map for each piece of property included therein; <br />and <br /> <br />WHEREAS, <br /> <br />the properties listed therein have, upon or in front <br />of them, weeds rubbish or refuse, such as defined by <br />§39561.5 of the Government Code; and <br /> <br />WHEREAS, <br /> <br />after consideration of evidence, both oral and documen- <br />tary, it appears clear that said weeds, rubbish or refuse <br />are a public nuisance in that they constitute a fire <br />hazard, or that said materials are noxious or dangerous <br />and, as such, are detrimental to the health, safety and <br />welfare of the City of Pleasanton and, as such, shall be <br />removed; and <br /> <br />WHEREAS, it appears that the public nuisances referred to herein <br /> are recurrent and seasonal in nature. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1: That the weeds, rubbish or refuse upon or in front of <br /> the properties described in the list attached hereto <br /> and incorporated by reference herein, are declared a <br /> public nuisance and are to be abated and removed pursuant <br /> to the procedure provided for in §39560, et seqo of the <br /> Government Code. <br /> <br />Section 2: That the public nuisances described herein are of a <br /> seasonal and recurrent nature. <br /> <br />Section 3: That on April 14, 1980, at the hour of 8:00 p.m., at <br /> the Pleasanton City Council Chambers, Alameda County <br /> Fairgrounds Cafeteria, the City Council will hear and <br /> consider objections to the abatement and removal of said <br /> public nuisance. <br /> <br /> <br />
