CITY COUNCIL OF THE CITY OF PLEASANTON ALAmeDA COUNTY, CALIFOR~]IA RESOLUTION NO. 81-70 RESOLUTION RESCINDING THE INTRODUCTION OF AN ORDINANCE AND DEFERRING ALTERNATIVE PLANS OF CASTLEWOOD PROPERTIES, INC. FOR HILLSIDE PLANNED DEVELOPMENT APPROVAL TO THE PLANNING COMMISSION WHEREAS, the City Council on March 10, 1981 approved three actions with regard to the Hillside Planned Development proposed by Castlewood Properties for a 48 acre site located on the west side of Foothill Road approximately 300 feet north of Bernal Avenue: (1) approved a mitigated negative declaration (Resolution No. 81-66); (2) denied the appeal of a variance granted by the Board of Adjustment (Resolution No. 81-67); and (3) introduced an ordinance granting development plan approval for a 20 lot project on the subject property; and WHEREAS, Mr. Dunkley, representing Castlewood Properties, Inc., subsequently asked for clarification of the action taken by the City Council, specifically as to which of the alternative plans were approved; and ~IEREAS, it appeared that the alternative plan, in modified form., was the plan favored by the City Council, but that the Planning Con~nission had not reviewed and reported on this alternative as required by law; and WHEREAS, it also appeared that all the data required to be presented as part of an Hillside Planned Development submittal were not presented during the hearings on the project; and WHEREAS, both the applicant, Castlewood Properties, Inc., and the City Council are concerned about the possibly incorrect procedures followed prior to introduction of the ordinance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council rescinds and repeals its action in introducing the ordinance.
