k~tEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-67 <br /> <br />RESOLUTION DENYING THE APPEAL OF LEE HENDERSON TO <br />A DECISION OF THE BOARD OF ADJUSTmeNT APPROVING A <br />VARIANCE IN CASE V-81-2 (CASTLEWOOD PROPERTIES) <br /> <br />at its meeting of February 17, 1981, the Board of <br />Adjustment approved case V-81-2, the application <br />of Art Dunkley (Castlewood Properties, Inc.) for a <br />variance from Article 32 of the Zoning Code to <br />allow construction of a 20 lot Hillside Planned <br />Development on the 48 acre site located on the <br />west side of Foothill Road near its intersection <br />with Bernal Avenue without the required amount of <br />open space; and <br /> <br />~IEREAS, <br /> <br />within the time specified by the Ordinance Code of <br />the City of Pleasanton, a neighboring property <br />owner, Lee Henderson, submitted an appeal to the <br />City Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, <br /> <br />at its meeting of March 10, 1981, the City Council <br />received a report from the Director of Planning <br />and Community Development together with a copy of <br />the Staff Report to the Bqa~d of Adjustment <br />regarding this matter; and <br /> <br />WIIEREAS, <br /> <br />the City Council held a public hearing at which <br />time applicant and any other member of the public <br />was offered an opportunity to present evidence <br />regarding this appeal; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section <br /> <br />1: Denies the appeal of Lee Henderson to a decision <br /> of the Board of Adjustment approving a variance in <br /> Case V-81-2 (Castlewood Properties, Inc.). <br /> <br />Section 2: In denying the appeal of Mr. Henderson, Council <br /> makes the following findings in support of the <br /> variance: <br /> <br />That because of special circumstances applicable <br />to the subject property, including size, <br />shape, topography, location or surrounds, the <br />strict application of the provisions of the <br />Zoning Code would deprive the property of <br />privileges enjoyed by other properties in the <br />vicinity and under identical zoning classification. <br /> <br /> <br />
