CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION 81-101 <br /> <br />RESOLUTION APPROVING TRAFFIC SIGNALIZATION PARTICIPA- <br />TION FOR TRACT 4539 (CENTEX HOMES/CORK HARBOUR) <br /> <br />WHEREAS, <br /> <br />as a condition of PUD approval, the developer was to <br />carry out a sthdy to determine the need to signalize the <br />intersection of First Street and Pico and was to enter <br />into an agreement with the City to pay his fair share of <br />the cost of installation of such signal; and <br /> <br />WHEREAS, <br /> <br />the developer has presented a traffic study which indicates <br />a traffic signal will not be needed immediately but will be <br />necessary in the future; and <br /> <br />WHEREAS, <br /> <br />Centex Homes has submitted a letter suggesting their signal <br />costs should be $7,000 with the City paying the other half <br />because the Bernal realignment will eventually connect to <br />the Pico/First intersection; and <br /> <br />WHEREAS, <br /> <br />Council has received a report from staff dated April 8, <br />1981 indicating the Pico/First intersection will eventually <br />warrant a signal regardless of whether or not Bernal Avenue <br />is connected and that Centex should pay $14,000. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section <br /> <br />1. City Council determines that the developer's "Fair <br />Share" of signal cost participation for the Pico/First <br />traffic signal is $14,000. <br /> <br />Section 2. City Council determines that the amount of participation <br /> shall be paid as an in-lieu fee to be collected before <br /> filing the final map for Tract 4539. <br /> <br />Section 3. This resolution shall become effective immediately upon <br /> its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON APRIL 14, 1981, BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers Butler, Kephart, Moh Wood and Mayor Mercer <br />NOES: None ~Pnar~~~MECE~R,~ <br />ABSENT: None <br />ABSTAIN: None <br />ATTEST: <br /> <br />By Doris George, Deputy City Clerk~~-~ <br /> , City Attorney <br /> <br /> <br />
