CITY OF PLEASANTON <br /> <br />DEFERRED COMPENSATION P]~AN <br /> <br />EXHIBIT A <br /> <br />SECTION 1. <br />SECTION 2. <br /> <br />SECTION 3. <br /> <br />NAME: The name of this Plan is the City of Pleasanton Deferred <br />Compensation Plan (hereinafter referred to as the Plan). <br /> <br />PURPOSE: The primary purpose of the Plan is to authorize eligible <br />employees to enter into agreement with the City of Pleasanton which <br />will provide for deferral of payment of a portion of their current <br />compensation until death, disability, retirement, termination of <br />employment, or other event as provided herein, in accordance of <br />with the provisions of Sections 53212-53214 of the Government Code <br />of the State of California, and Section 457 of the Internal Revenue <br />Code. <br /> <br />DEFINITIONS: For the purposes of this Plan certain words or phrases <br />used herein will have the following meanings: <br /> <br />3.1 "Employer" shall be the City of Pleasanton. <br /> <br />3.2 <br /> <br />"Eligible Employee" shall mean PCEA Bargaining Unit Members. <br /> (enter who is eligible) <br /> <br />3.3 <br /> <br />"Participant" means an employee who is eligible to defer <br />compensation under the Plan and has elected to participate in <br />the Plan by signing a participation agreement. <br /> <br />3.4 <br /> <br />"Participation Agreement" shall mean the agreement executed and <br />filed by an eligible employee with the employer pursuant to <br />Section 4, in which the employee elects to become a participant <br />in the Plan. <br /> <br />3,5 <br /> <br />"Beneficiary" may be any person, trust, corporation or firm, or <br />any combination of the foregoing designated by a Participant to <br />receive benefits under the Plan. Designation shall be by written <br />instrument executed by the Participant unless otherwise provided. <br />Beneficiary may be singular or plural, primary or centingent. <br /> <br />3.6 "City Manager" means the Employer and/or other parties appointed <br /> by the Employer to administer the Plan. <br /> <br />3.7 <br /> <br />"Compensation" means the total of all amounts which would be <br />paid by the employer to or for the benefit of an Employee <br />(if he were not a participant in the Plan) for actual services <br />for the period that he is a Participant. <br /> <br />3.8 <br /> <br />"Payroll Period" means the work period for which a pay check is <br />issued. <br /> <br />-1- <br /> <br /> <br />
