CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-134 <br /> <br />ACCEPTANCE OF YOUTH SPORTS PARK PHASE III FIELD <br />IMPROVEMENTS, PROJECT 81-4 <br /> <br />WHEREAS , <br /> <br />work by Alameda Fence, Inc. on the field improvements <br />of Youth Sports Park, Phase III, Project No. 81-4, <br />has progressed satisfactorily to completion; and <br /> <br />~{EREAS, it is appropriate to authorize the final progress <br /> payment. <br /> <br />WHEKEAS, <br /> <br />because Alameda Fence, Inc. painted the backboards and <br />dugout roofs while the lumber was wet, the paint is now <br />blistering and peeling as the wood dries; and <br /> <br />Alameda Fence, Inc., has agreed in writing to return <br />in July to clean and repaint the backstops and dugout <br />roofs.~ <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The field improvements of Youth Sports Park Phase III <br /> are hereby accepted. <br /> <br />Section 2: The Director of Finance is instructed to prepare a <br /> warrant in the amount of $48,775.32 in favor of Alameda <br /> Fence, Inc. or its assignee, in satisfaction of the <br /> final progress payment for the above accepted work on <br /> Project No. 81-4. The sum of $7,810.84 will be retained <br /> until thirty (30) days after filing of the Notice of <br /> Completion. <br /> <br />Section 3: The sum of $5,007.60 is to be withheld as a guarantee <br /> that the contractor will return to do the appropriate <br /> repainting and/or repair work to the City's satisfaction. <br /> <br />Section 4: The City Attorney is directed to file a Notice of <br /> Completion with the Alameda County Recorder. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its adoption. <br /> <br />THIS RESOLUTION ADOPTED MAY 12, 1981 BY THE FOLLOWING VOTE: <br /> <br /> <br />
