CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-148 <br /> <br />RESOLUTION INITIATING AMENDMENT TO CHARITABLE <br />SOLICITATION ORDINANCE <br /> <br />WHEREAS, <br /> <br />the recent case of Hillman vs. Britton, decided by <br />the 5th District Court of Appeal of the State of <br />California, invalidated the charitable solicitation <br />ordinance of the City of Fresno; and <br /> <br />WHEREAS, <br /> <br />portions of the Ordinance Code of the City of Pleasanton <br />are similar to those sections invalidated by the recent <br />decision; and <br /> <br />WHEREAS, <br /> <br />it is recommended by the City Attorney's office that <br />the City Council initiate an amendment to the charitable <br />solicitation ordinance to bring it into conformity with <br />current constitutional provisions. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council initiates an amendment to the <br /> charitable solicitation ordinance to bring it into <br /> conformity with current constitutional provisions. <br /> <br />Section 2: Suspends enforcement of those portions of the ordinance <br /> which are constitutionally defective. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its adoption. <br /> <br />THIS RESOLUTION ADOPTED MAY 12, 1981 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers Butler, Kephart, Mohr, Wood and Mayor Mercer <br /> NOES: None ~ <br /> ABSENT: None <br /> <br /> CER, MAYOR <br /> <br /> James R.'Walker, /i~y Cle <br /> By Doris George, Deputy City Clerk <br /> <br />APPROVED AS TO FORM: <br /> <br />vie~ <br /> °, City Attorney <br /> <br /> <br />
