CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-176 <br /> <br />ACCEPTANCE OF STORM DRAINAGE EASEMENT FROM WILCOXES <br />AND AUTHORIZATION TO EXECUTE INDEMNIFICATION AGREEMENT <br /> <br />WHEREAS, <br /> <br />the City is <br />purposes of <br />of George E. <br /> <br />in receipt of a perpetual easement for <br />installing a storm drain under the property <br />and Mary Louise Wilcox; and <br /> <br />WHEREAS, <br /> <br />as a condition of granting the easement, the Wilcoxes <br />have asked for an Indemnification Agreement by which the <br />City agrees to hold them harmless in the event that some <br />injury should take place on their property due to the <br />presence of the storm drain; and <br /> <br />WHEREAS, <br /> <br />at their meeting of June 9, 1981, the City Council <br />received a report from the City Attorney indicating <br />that the acceptance of this storm drainage easement <br />and execution of the Indemnity Agreement is in the <br />public interest. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Authorizes the acceptance of a storm drain easement <br /> from George E. and Mary Louise Wilcox. <br /> <br />Section 2: Authorizes the Mayor to execute the Indemnification <br /> Agreement between the City of Pleasanton and George E. <br /> and Mary Louise Wilcox. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON JUNE 9, 1981 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers Butler, Kephart, Mohr, Wood and Mayor Mercer <br /> NOES: None <br /> ABSENT: None ~R <br /> ~ CER, MAYOR <br />~J~ames R.
