CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-175 <br /> <br />AUTHORIZING QUITCLAIM OF EXISTING EASEMENT <br />AND ACCEPTANCE OF REVISED STORM DRAIN EASEMENT <br />FROM JOSEPH MADDEN <br /> <br />WHEREAS, the City is in receipt of a storm drain easement from <br /> Joseph Madden; and <br /> <br />WHEREAS, <br /> <br />because the existing easement would endanger a large <br />English walnut heritage tree, Mr. Madden has requested <br />that the easement be realigned; and <br /> <br />WHEREAS, <br /> <br />at their meeting of June 9, 1981, the City Council <br />received a report from the City Attorney indicating <br />that the acceptance of this realigned easement is in <br />the public interest. <br /> <br />NOW, THEREFORE, TIM CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Authorizes the Mayor to execute a Quitclaim Deed <br /> abandoning the existing storm drainage easement. <br /> <br />Section 2: The Grant Deed for the realigned storm drainage <br /> easement from Joseph Madden to the City of Pleasanton <br /> is hereby accepted and the appropriate City officers <br /> are instructed to take whatever action necessary to <br /> implement said acceptance. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON JUNE 9, 1981 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood and Mayor Mercer <br />NOES: None <br /> <br />By Doris George, Deputy City Clerk <br /> <br />APPROVED AS TO FORM: <br /> <br />City Attorney <br /> <br /> <br />
