CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-181 <br /> <br />A RESOLUTION DECLARING NECESSITY A~D AUTHORIZING <br />THE CONDEMNATION OF A PARCEL OF LAND FOR STREET <br />PURPOSES OF 17,088 SQ. FT. IN FEE SIMPLE ABSOLUTE <br />CONSISTING OF ASSESSOR'S PARCEL NO. 94-156-12-4 <br />IN THE CITY OF PLEASANTON, COUNTY OF ALAMEDA <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: <br /> <br />Section 1: That the City Council, after notice and hearing <br /> pursuant to Section 1245.235 of the Code of Civil Procedure, <br /> finds and determines and hereby declares that: <br /> <br />The hereinafter described real property is necessary <br />for a public use, to wit: a public street, and is <br />to be acquired by eminent domain pursuant to Section <br />1240.010. <br /> <br />b. The public interest and necessity require the proposed <br /> public project. <br /> <br />The proposed project is planned and located in the <br />manner that will be most compatible with the greatest <br />public good and the least private injury. <br /> <br />d. The property sought to be acquired and described by <br /> this resolution is necessary for the proposed project. <br /> <br />Section 2: That the City Attorney is hereby authorized and <br /> empowered to acquire in fee simple the hereinafter described <br /> real property by condemnation proceeding or proceedings <br /> in accordance with the provisions of the Code of Civil <br /> Procedure and of the Constitution of the State of California <br /> relating to eminent domain. <br /> <br />Section 3: That the real property hereinabove referred to is <br /> a 17,088 square foot parcel owned by the estate of Emile <br /> Narcisi and administered by Mrs. Ruth Pica known as <br /> Alameda County Assessor's Parcel No. 94-156-12-4 and <br /> commonly known as 171 Bernal Avenue. The parcel to <br /> be acquired is fully described on Exhibit A attached <br /> hereto and incorporated by reference herein. <br /> <br />Section 4: This resolution shall take effect immediately upon <br /> its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JUNE 9, 1981 BY THE FOLLOWING VOTE: <br /> <br /> <br />
