CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 81-181 A RESOLUTION DECLARING NECESSITY A~D AUTHORIZING THE CONDEMNATION OF A PARCEL OF LAND FOR STREET PURPOSES OF 17,088 SQ. FT. IN FEE SIMPLE ABSOLUTE CONSISTING OF ASSESSOR'S PARCEL NO. 94-156-12-4 IN THE CITY OF PLEASANTON, COUNTY OF ALAMEDA THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: That the City Council, after notice and hearing pursuant to Section 1245.235 of the Code of Civil Procedure, finds and determines and hereby declares that: The hereinafter described real property is necessary for a public use, to wit: a public street, and is to be acquired by eminent domain pursuant to Section 1240.010. b. The public interest and necessity require the proposed public project. The proposed project is planned and located in the manner that will be most compatible with the greatest public good and the least private injury. d. The property sought to be acquired and described by this resolution is necessary for the proposed project. Section 2: That the City Attorney is hereby authorized and empowered to acquire in fee simple the hereinafter described real property by condemnation proceeding or proceedings in accordance with the provisions of the Code of Civil Procedure and of the Constitution of the State of California relating to eminent domain. Section 3: That the real property hereinabove referred to is a 17,088 square foot parcel owned by the estate of Emile Narcisi and administered by Mrs. Ruth Pica known as Alameda County Assessor's Parcel No. 94-156-12-4 and commonly known as 171 Bernal Avenue. The parcel to be acquired is fully described on Exhibit A attached hereto and incorporated by reference herein. Section 4: This resolution shall take effect immediately upon its passage and adoption.
