CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-204 <br /> <br />RESOLUTION APPROVING THE APPEAL OF ~RT MURRAY <br />FOR A VARIANCE RELATING TO FENCING IN REQUIRED <br />YARDS AT THE NORTHWEST CORNER OF NORTON WAY AND <br />PALOMINO DRIVE <br /> <br />WHEREAS, <br /> <br />Mert Murray applied to the Board of Adjustment for a <br />variance to the zoning code to allow the installation <br />of fencing which would encroach into the required <br />front and side yard setbacks of the townhouse <br />development located at the northwest corner of Norton <br />Way and Palomino Drive; and <br /> <br />~IEREAS, <br /> <br />at their meeting of May 13, 1981, the Board of Adjustment <br />gave approval only to allow the encroachment of fencing <br />into the required setback on the Norton Way side of the <br />subject site and the encroachment was denied on the <br />Palomino Drive side of the project; and <br /> <br />WHEREAS, the denial was appealed to the City Council; and <br /> <br />WHEREAS, <br /> <br />the City Council received a staff report, minutes of <br />the Board of Adjustment meeting, and held a public hearing <br />on June 23, 1981 to receive comments from the applicant <br />and the public. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council makes the following findings: <br /> <br />That because of special circumstances of the subject <br />case relating to surroundings, the strict application <br />of this provision of this chapter would deprive the <br />applicant of privileges enjoyed by other properties <br />in the vicinity, i.e. other multiple-residential <br />properties in the vicinity have structures which <br />come to within less than 20 feet of the front property <br />line. <br /> <br />That because of the special circumstances mentioned in <br />subparagraph (a) above, the variance will not constitute <br />a grant of special privilege inconsistent with the <br />limitation on other properties classified in the <br />same zoning district. <br /> <br /> <br />
